Annulment of Marriage or Civil Union in NJ

Legislation is being considered in the NJ Assembly offering an abbreviated annulment option for NJ couples. If this legislation becomes law, either party to a marriage or civil union in NJ may receive an annulment without stating any cause as long as the annulment is demanded within 30 days of the ceremony. NJ 2A:34-1 is the statute controlling causes for judgments of nullity. The proposed change for married couples includes a cause for nullity if "either party demands such a judgment and less than 30 days have passed from the date of the marriage ceremony." The proposed change for same-sex couples includes a cause for nullity if "either party demands such a judgment and less than 30 days have passed from the date of the civil union ceremony." Although not yet passed, this law would offer the opportunity to quickly remedy what is quickly determined by either party to be a mistake.
